These Terms & Conditions (the “Terms”) govern your use of our website, our online ordering system, and the purchase and delivery of food and products from us.  Compass Menu is located in Maroochydore, Queensland, Australia. By placing an order through our website or using any part of our service, you agree to be bound by these Terms, which are subject to the Australian Consumer Law (ACL).

2. Online Orders and Contract Formation

2.1. Offer and Acceptance: All orders placed through our website are an offer to purchase the products and services listed. We reserve the right to accept or reject any order at our discretion, including for reasons such as lack of availability, error in pricing, or issues with delivery location.

2.2. Confirmation: A contract for the sale of food and services is formed when we send you an email or digital confirmation that your order has been accepted and payment has been successfully processed.

2.3. There is no minimum order when a main meal is included.
Sides or drinks cannot be delivered on their own and must be ordered with a main meal.

3. Pricing and Payment

3.1. Currency: All prices listed are in Australian Dollars (AUD) and include the Goods and Services Tax (GST) where applicable.

3.2. Delivery Fee: A delivery fee will apply to all delivery orders and will be clearly displayed during the checkout process.

3.3. Payment must be made in full at the time of placing the online order. We accept major credit/debit cards and other payment methods as listed on our website. You may choose to pay by bank transfer to avoid card surcharges or for your convenience; however, the transfer must be completed before we begin preparing your order.

3.4. Errors: While we strive for accuracy, in the event of an error in the pricing or description of a product, we reserve the right to cancel or correct the order and provide you with a full refund.

4. Delivery Service

4.1. Delivery Area: Our delivery service is limited to the areas within Maroochydore and surrounding suburbs as specified on our website. We reserve the right to decline an order if the delivery address is outside our defined service area.

4.2. Delivery Times: Estimated delivery times are provided as a guide only. We strive to meet all stated times, but circumstances beyond our control (e.g., traffic, weather, high demand) may cause delays. Compass Menu is not liable for any loss or damage (other than as required by the ACL) suffered due to a delay in delivery.

4.3. Completion of Delivery:

* Presence: It is your responsibility to ensure that the correct address is provided and that you or a nominated person is available to receive the order at the specified time.

* Unattended Delivery (Authority to Leave): If you provide an ‘Authority to Leave’ and your order is left unattended at your premises, the order will be considered delivered and you accept full responsibility for any loss, damage, or theft that may occur thereafter. We strongly recommend immediate collection, especially for hot or cold items.

* Failed Delivery: If a delivery fails due to incorrect address information provided by you, or if our driver cannot safely or reasonably complete the delivery, we reserve the right to charge you for the order and any redelivery fee, or to cancel the order without a refund.

5. Cancellation and Refunds

5.1. Your Right to Cancel: You may cancel an order only if we have not yet started preparing the food. Once food preparation has begun, the order cannot be cancelled and no refund will be issued. Please contact us immediately by phone to inquire about cancellation.

5.2. Our Right to Cancel: We may cancel your order at any time, for any reason (e.g., ingredient unavailability, technical issue), and will provide a full refund.

5.3. Australian Consumer Law (ACL): Our goods and services come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods replaced or refunded if the goods fail to be of acceptable quality and the failure does not amount to a major failure. * Faulty Goods: If you receive food that is incorrect, materially different from the description, or clearly substandard (e.g., due to spoilage or significant preparation error), you must notify us immediately (within a reasonable time of receiving the order) and may be entitled to a replacement or refund under the ACL. Photographic evidence may be required.

6. Allergens and Dietary Requirements

6.1. Disclaimer: As a cafe offering a wide variety of global and classic dishes, our kitchen handles numerous ingredients including nuts, peanuts, gluten, dairy, eggs, soy, and shellfish. We take reasonable steps to prevent cross-contamination, but we cannot guarantee that any dish is 100% free of allergens.

6.2. Customer Responsibility: If you or a member of your party has a severe food allergy or intolerance, you must clearly state this in the order notes and also contact the cafe by phone to discuss your requirements before placing your order.

6.3. Acceptance of Risk: By ordering from us, you acknowledge and accept this risk and agree that Cafe Compass will not be liable for any adverse reactions resulting from consuming our food due to allergen exposure.

7. General Website Use

7.1. Intellectual Property: All content on this website (including text, graphics, logos, images, and menu design) is the property of Cafe Compass or its content suppliers and is protected by Australian and international copyright laws.

7.2. Prohibited Use: You must not use our website or services for any unlawful or prohibited purpose, or in any way that could damage, disable, or impair the site.

7.3. Privacy: Your personal information is handled in accordance with our Privacy Policy (accessible separately on this website) and complies with the Privacy Act 1988 (Cth).

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Queensland, Australia, and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.
